Date received

I do not have the specific information within my Knowledge Base regarding the agreements between NLWA and Hackney Council for the tipping of commercial waste, particularly waste collected outside of the borough.
I wish to know if Hackney Council is permitted to dispose of Commercial Waste collected outside of the borough within NLWA as set out;
We are a statutory public authority, committed to serving over two million north London residents in Barnet, Camden, Enfield, Hackney, Haringey, Islington and Waltham Forest.

Good afternoon,

Further to our email acknowledging your freedom of formation request (reference 2026-292), our response is as follows.

Your request:
I do not have the specific information within my Knowledge Base regarding the agreements between NLWA and Hackney Council for the tipping of commercial waste, particularly waste collected outside of the borough.
I wish to know if Hackney Council is permitted to dispose of Commercial Waste collected outside of the borough within NLWA as set out;
We are a statutory public authority, committed to serving over two million north London residents in Barnet, Camden, Enfield, Hackney, Haringey, Islington and Waltham Forest.

Our response:

The arrangements between NLWA and its constituent boroughs are governed by the Inter-Authority Agreement (IAA), which is publicly available on NLWA's website: https://www.nlwa.gov.uk/sites/default/files/inline-files/Inter%20Authority%20Agreement%20%28Certified%20Copy%29%20redacted.pdf

Under the IAA, constituent boroughs may deliver both household waste and non-household waste (otherwise known as commercial waste) to NLWA facilities, subject to the relevant charging arrangements. The Agreement defines non-household waste by the nature of the waste and applicable statutory classifications; it does not distinguish waste according to the location from which it was collected.

Accordingly, NLWA has not identified any provision within the Inter-Authority Agreement that would prevent a constituent borough from delivering eligible non-household waste to NLWA facilities solely on the basis that it was collected outside a constituent borough's administrative area.

If you are dissatisfied with the handling of your request, you may ask for an internal review, which should be submitted within two months of when you received our response to either informationrequests@nlwa.gov.uk or enquiry form quoting the above reference.

If you are not content with the outcome of the review, you may complain to the Information Commissioner, Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF, or via their online portal. The Information Commissioner will not usually accept complaints before a review has been completed.
